Terms and Conditions

 

  1. In these conditions the following words have the following meanings.
    1. ‘Customer’ means the person, firm, company or other organisation buying the goods.
    2. ‘Force Majeure’ means any event outside a party’s reasonable control including but not limited to acts of god, war, flood, fire, labour disputes, riots and other similar events.
    3. ‘Contract’ means a contract which incorporates these conditions and made between the Customer and the Supplier for the sale/purchase of Products.
    4. ‘Liability’ means liability for any and all damages, claims, proceedings, actions, awards, expenses, costs and any other losses and / or liabilities.
    5. ‘Products’ means the products sold to the Customer by the Supplier.
    6. ‘Supplier’ means CosyCalf Ltd and will include its employees, servants, agents and / or duly authorised representatives.
  2. Nothing in this contract shall affect the statutory rights of the Customer.
  3. Payment shall be made in full by the Customer to the Supplier in full prior to despatch of the Product(s) and can only be varied in writing by the directors. The customer shall pay all sums due without set off, deduction counter claim or any other withholding of monies. If the Customer fails to make any payment in full on the due date the Supplier may charge the Customer interest (both before and after judgement) on the amount outstanding at the rate allowed by law under the late payment of Commercial Debts (Interest) Act
  4. Insurance risk shall pass from the Supplier to the Customer as soon as the Product has left the Suppliers premises
  5. Ownership of the goods shall not pass to the Customer until full payment has been received and cleared into the Suppliers bank account.
  6. It is the Customers responsibility to make themselves available to receive the goods and in the event of a failed delivery, to arrange re-delivery or collection by themselves at their own cost.
  7. The Customer shall advise the Supplier of any shortage or damage in or to the product within 24hours of receipt after which time no claims shall be entertained.
  8. No refunds will be offered or made except where it is proved the product has failed due to manufacturing defect or fault.
  9. All warranties, representations, terms, conditions and duties implied by law relating to fitness and / or quality are excluded to the fullest extent permitted by law.
  10. If the supplier is found to be liable in respect of any loss or damage the extent of the Suppliers Liability will be limited to the retail cost of replacement cost of the Product.
